FEDERAL IT TRANSFORMATION LEADS TO INCREASED EMPHASIS ON SPEED, AGILITY AND NON-TRADITIONAL ACQUISITION METHODS
The emphasis on non-traditional federal acquisition methods is increasing. Acquisition transformation bodes well for online talent
marketplace buyers and sellers who can now respond quickly and effectively to support accelerated government-wide technology
transformation and IT modernization initiatives. Demand is increasing for specialties in artificial intelligence, blockchain,
cybersecurity and other cutting edge technologies. Innovative acquisition methods receiving additional emphasis include:
Other Transaction Authority (OTA) – Beginning with the NASA Space Act of 1958 OT’s have been a tool
for the Federal R&D Community. An OT is a legally binding procurement agreement between government and industry authorized for
scientific research, technology development, and prototype projects. OTA’s are designed to help accelerate innovation and expand
the industrial base by including Silicon Valley-like small businesses and non-traditional contractors. The focus is on cutting-edge
technologies and not only IT-related innovations. The OT agreement uses a non-FAR based accelerated process to save time and money
for innovative projects. OTA’s are currently available to DOD and seven civilian agencies.

Solutions Openings (CSO) Pilot Program – A CSO is a relatively new acquisition approach providing a
streamlined process and simplified contract terms to increase competition from a pool of solutions at a better cost and performance.
Section 880 of the FY17 NDAA authorized GSA to implement a pilot program to competitively procure innovative commercial items,
technologies, and services using CSO procedures. A CSO is also a non-FAR based streamlined acquisition process enabling a focus on
best value. CSO’s are currently limited to DOD, DHS and GSA. For additional information please

Small Business Innovative Research (SBIR) Phase III Program – SBIR III promotes innovative approaches by small non-traditional private sector companies. The SBIR program is a competitive awards-based Small Business Administration Program to encourage small business research/research and development (R/R&D) providing incentives for them to profit from commercialization.
The program is structured in three phases; Phases I and II focus on R/R&D, while Phase III’s objective is to pursue commercialization objectives resulting from Phase I/II R/R&D activities. Contracting officers have the ability to award a phase III contract without competition as long as the product or service arises from or logically concludes a phase I or phase II award. Section 809 Advisory Panel on Streamlining and Codifying Acquisition Regulations – The Panel was established by Congress in the FY2016 NDAA. The Panel’s findings recommended both evolutionary and revolutionary changes allowing the Department of Defense to make purchases in a manner similar to the private-sector businesses. The 809 Panel Final Report highlighted GovFlex as a new approach related to Recommendation 45 to create a pilot program for contracting directly with IT consultants through an online talent marketplace.
